Skype Limited has won its case following a complaint to the National Arbitration Forum asserting legal rights over two disputed domain names.
The domain names in question were SkypeChina.com and ChinaSkype.net and were owned by China Online Limited. The domains resolved to a website which advertised China Online’s business and listed an extensive domain name portfolio.
Skype Limited argued that the domain names had been registered in bad faith as they were confusingly similar to their trademark of “Skype which is held with the United States Patent and Trademark Office. They further argued that Internet users searching for Skype’s communication services and landing on one of the disputed domains could become confused as to China Online’s sponsorship or association with Skype.
The Panel ordered that the disputed domain names be transferred to Skype Limited.
